If the Court finds in your favour, you should be able to recover these from your opponent.
However, if the Court finds against you, you will be expected to pay the other side’s costs.
These can be very very substantial, as solicitors and barristers charge in the £’00′s per hour.
These costs will be claimed after a Hearing, and if not agreed subject to a “taxing” Hearing, where an entirely different Court will decide what is fair. This can be a further expensive process.
Before anyone becomes a LiP they should investigate the impact on your lie of what can be very substantial cost figures, certainly into the tens if not hundreds of thousands of pounds, if you fail to convince the Court.
Before you start being a LiP, you should consider all other avenues of dispute resolution.
